Terms of Service
These terms govern your use of NavIsh Prep, a K–12 assessment practice application operated by NavIsh LLC, a Minnesota limited liability company (“NavIsh”, “we”, “us”). By creating an account or using the app, you agree to them. If you do not agree, please do not use the app.
1. Who may use NavIsh Prep
You must be at least 18 years old and the parent or legal guardian of each child whose profile you create. The account belongs to you, the adult — not to a child. Children use the app through a profile you create and manage, and parent-facing areas including account settings, billing and reports sit behind a parental check.
You are responsible for everything that happens under your account, including your child’s use of it. Keep your password and Parent PIN confidential, and tell us promptly if you believe either has been compromised.
2. What NavIsh Prep is — and is not
NavIsh Prep provides independent practice material aligned to publicly published academic standards and to the general formats of widely used assessments.
We are not affiliated with, endorsed by, sponsored by or associated with any test publisher, school, school district or state education agency. FastBridge®, CogAT®, NWEA®, MAP®, STAAR®, PSAT/NMSQT®, SAT®, ACT® and other assessment names are trademarks of their respective owners and are used only to describe what our practice material prepares for. Our items are our own; they are not actual, retired or leaked test questions, and NavIsh Prep is not an official test instrument.
3. No guarantee of results
Practice can help a child become familiar with a format and reveal which skills need work. It cannot promise an outcome. We make no guarantee of any score, percentile, grade, placement, gifted program admission, or academic or admissions result of any kind.
Scores, percentiles and skill breakdowns the app produces are indicators derived from practice sessions. They are not clinical, psychological or educational diagnoses, are not a substitute for professional evaluation, and should not be used to make decisions about medical treatment, special-education eligibility or formal placement. Speak to your child’s school or a qualified professional for those.
4. Your account
You agree to give accurate information when you register and to keep it current. We may suspend or close an account that is used in breach of these terms, that appears to be registered by someone under 18, or that is used to attempt to extract our item bank.
You can delete your account, and all child profiles and practice history attached to it, from inside the app at any time. No email or phone call is required.
5. Child profiles and the data in them
You decide what to put in a child’s profile. We ask for a first name or nickname and a grade level, and we ask for nothing more — please do not enter a surname or any other identifying detail. Our handling of all personal information is described in the Privacy Policy, which forms part of these terms.
6. Subscriptions, billing and renewal
A NavIsh Prep subscription covers every child on the account, with unlimited practice sittings and the full report after each one. Any free practice we offer from time to time is described where it is offered, and we may change or withdraw it.
Current plans are $12.99 per month, $24.99 every three months and $79.99 per year, in US dollars. The price charged in your own currency is set by the app store and shown on the purchase screen before you confirm.
- Who charges you. Subscriptions purchased in the iOS or Android app are sold and billed by Apple or Google through your store account, under that store’s terms. We never see your card details.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel. The price, billing period and renewal terms are disclosed on the purchase screen before you buy.
- How to cancel. Cancel at any time in your store account — Settings → your name → Subscriptions on iOS, or the Play Store → Subscriptions on Android. Canceling stops the next renewal; access continues to the end of the period you have already paid for. The app also links you directly to the right screen.
- Refunds. Because Apple and Google take the payment, refunds are handled under their policies and requested through them. We will help you with a request, but we cannot issue a refund for a charge we did not process.
- Price changes. We may change prices. A change will not affect a period you have already paid for, and you will be given notice and the chance to cancel before it takes effect, as the app stores require.
7. Acceptable use
You agree not to:
- copy, scrape, bulk-download, republish, resell or redistribute our questions, passages, diagrams, reports or other content;
- use the app to build, train or evaluate a competing product or a machine-learning model;
- share one account across families, or resell or sublicense access;
- probe, scan or interfere with the service, bypass the parental check or any rate limit, or attempt to reach another family’s data;
- use the app for anything unlawful, or in breach of your school district’s or test publisher’s own rules.
8. Our content and your license
All questions, passages, diagrams, reports, software, text and design in NavIsh Prep are owned by NavIsh LLC or its licensors and are protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app and to use and print its practice material and reports for the personal educational use of the children on your own account. That license ends when your account or subscription ends.
9. Availability and changes
We work to keep the app available, but we do not promise uninterrupted service. We may modify, suspend or discontinue features, and we may add, change or retire practice material — including withdrawing an item we find to be flawed. Scheduled maintenance, outages at our hosting or authentication providers, and your own connectivity can all interrupt access.
10. Disclaimers
To the fullest extent permitted by law, the app and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, NavIsh LLC and its members, officers and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or any academic, admissions or placement outcome, arising out of or relating to your use of the app.
Our total liability for all claims relating to the app is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) fifty US dollars. Some jurisdictions do not allow these limits, so they may not apply to you.
12. Indemnity
You agree to indemnify and hold NavIsh LLC harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of the app.
13. Termination
You may stop using the app and delete your account at any time. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if we discontinue the service. Sections 8, 10, 11, 12 and 14 survive termination.
14. Governing law and disputes
These terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules.
Before starting any formal proceeding, please email us at customer-support@navishprep.com and give us 30 days to try to resolve the matter. Most problems are a misunderstanding and are quicker to fix this way.
If we cannot resolve it, any dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Hennepin County, Minnesota, or by videoconference at your election. Each of us waives the right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these terms; opting out does not affect the rest of these terms. Either of us may still bring an individual claim in small-claims court, and nothing here prevents you from reporting a concern to a government agency.
15. Changes to these terms
We may update these terms. If a change is material, we will give notice in the app or by email before it takes effect, and the “last updated” date above will change. Continuing to use the app after a change takes effect means you accept the revised terms. If you do not, you may cancel and delete your account.
16. Contact
Questions about these terms are welcome. Privacy requests go to their own address, because they carry legal deadlines and should not queue behind billing questions.
